I have a past due electric bill that I've been letting ride due to lack of funds but I've been keeping up with the current monthly bills. I have a 4 year old and a 12 year old in the house with me and the electric company, JCPL, is threating to turn off my power if I don't pay the past due by the 9th of November. Is that legal? How do I stop them?

The Winter Termination Program (WTP) states that regulated electric and gas utility companies cannot discontinue service to certain households during the period of November 15 through March 15. If people united and cut off gas service in summer and electric in winter would it hurt public utility comp?
Q. Public utility companies are getting away with murder and so is the cable co. Cable is not a necessity and we could live without it. I feel if people united and stood up to these companies they would be forced to lower their prices for gas and lights.

For a country to include gasoline in that category, it would have to be self-sufficient in its production, I think. When buying a house are you responsible for the previous owners public utility bill that they owe?
Q. House was purchased by a Federal Marshall sale and it was stated in the order the buyer would be responsible for only the property taxes. City will not turn on utilities until we pay the previous owners bill which was shut off in 2003. I think the bill should stay with the owner and not the property. The state is Kansas and the county is Clay.

A. I think they are trying to pull a fast one on you! There would be no legal reason WHY you would be responsible. Do they have a legal document stating you have to pay the previous utilities? They have to come up with one to show you before you pay. If not, they need to bill the previous owners, or sent the bill to collections. Then, they need to start a whole new billing for you! They know this..They cannot start a whole new billing for you until all the legal documents are signed and the place is yours. Period. You do have a lawyer handling this don't you? If not, call the Better Business Bureau, they will help you, or Land Lord Tenant. Good Luck!

A. Here.(Canada)...very little. You can't even have a family member or the like phone in to report a payment or get an outstanding balance to pay it for you. I work for a law office and when dealing in real estate transactions, searching the utility accounts is part of the due process. Unless you are acting for the seller, they won't even tell you the outstanding amount until the seller's solicitor has faxed and confirmed that the property is being sold and the information is necessary to be released.

A. Many electric and gas utilities are not government owned. Libertarians have no problem with shareholder owned companies. I own shares of Duke Energy and Spectra Energy myself. The private sector is also capable of owning water fountains and bathrooms. Water and sewage are generally government controlled. Libertarians may not like that, but it's probably not that big an issue with them compared to gun rights and "victimless crimes".

Does P.U.E. on a county plat map mean Public Utility Easement?

A. Yes, PUE does mean Public Utility Easement. Contact your County (or city) 'Department of Public Works'. They should be listed under Government Numbers in your phone book. This is the department that approves PUEs. They will be able to tell you what the easement is for and what their responsibilities are in providing proper drainage for your home. It is possible that the developer was supposed to provide drainage or that it is your responsibility. This is the place to find out.,

A. Yes, the hand driers do save energy. Think of it this way, you are very likely to throw away that paper towel in the trash can instead of recycling it. Sure, it puts C02 into the atmosphere to burn the coal that provides you with that electricity to create the heat that dries your hands... however its very insufficient compared to the energy it takes to process the pulp into paper, have it rolled, shipped, and then installed. If you were recycling it that may be different, but since I have never seen people recycle public bathroom paper towels (nor do I expect them to), it is safe to say hand drier is best. Also, that paper just ends up in a *dry* landfill where it will take forever to decompose. And if your area is nuclear-power… [cont.]

A. It's a trade off. You get a better product when there is a profit incentive. Why do you think people from countries come to the United States for special health needs? We need to make health insurance available for more people. Unfortunately, I don't think it would ever be 100% of the people. Another thing, what is wrong with people making money? If you earn it, so what? *As to having it government run via taxes, I can't think of a better way to waste money. Government is not the model of efficiency.
